1. Introduction These Terms and Conditions govern your use of our website and the services offered by Across Patagonia Limited (‘the Company’). By accessing and using this website, you accept these Terms and Conditions in their entirety. If you do not agree, you must refrain from using our website and services. 2. Services Offered The Company acts as a tour operator and travel agency, offering services of: - Designing and marketing tour packages. - Booking of transportation, accommodation and activities. - Advising travel arrangements. 3. Bookings and Payments 3.1 All bookings made are subject to availability and confirmation by the Company. 3.2 Payments must be made within the timescales indicated at the time of booking. Failure to make payment may result in cancellation of the booking without refund. 4. Cancellation Policy 4.1. Cancellations made with more than 30 days notice prior to the commencement of the service will receive a full refund, less an administrative charge of [indicate percentage or fixed amount], in accordance with the provisions of Article 3° bis of Law No. 19.496 on the Protection of Consumer Rights. 4.2. Cancellations made between 15 and 30 days prior to the service will be subject to a charge of 50% of the total value of the service. 4.3. Cancellations made less than 15 days in advance are non-refundable. 4.4. No refunds will be made for not showing up at the place and time agreed for the start of the service (‘no show’). 4.5. Modifications of dates or services are subject to availability and may generate additional costs, according to article 12 of the same law. 5. Limits of Liability 5.1. The Company acts as an intermediary between clients and service providers (hotels, transport, guides, etc.) as stipulated in Law Nº 20.423 which establishes the Institutional System for the Development of Tourism. It is not responsible for non-compliance or negligent acts of such suppliers. 5.2. In case of accidents, injuries or personal damages during the performance of the contracted activities, the responsibility lies with the service provider and/or the client, in accordance with article 42 of the Commercial Code. The Company shall not be liable for direct, indirect, incidental or consequential damages related to the use of the contracted services. 5.3. All clients are recommended to take out travel insurance to cover accidents, illness and unforeseen cancellations, in accordance with Law No. 20.667 on Insurance Contracts. 6. Use of the Website 6.1. The content of the website is protected by copyright under Law No. 17.336 on Intellectual Property. It is not permitted to reproduce, distribute or modify the content without prior written permission. 6.2. The Company does not guarantee that the website will be free of errors or interruptions, although it undertakes to resolve any technical problems as soon as possible. 7. Privacy and Data Protection 7.1. The Company collects and stores personal information of customers in accordance with Law No. 19.628 on the Protection of Privacy. 7.2. Personal data will not be shared with third parties without the consent of the client, except when necessary for the provision of contracted services. 8. Applicable Law and Jurisdiction These Terms and Conditions are governed by the laws of the Republic of Chile.
